Portable Fire Extinguishers - Exemptions

The employer is exempt from the distribution requirements of 1910.157 if an emergency action plan is established that meets the requirements of CFR 1910.38. This requirement establishes fire brigades and requires all other employees to evacuate.

The employer is exempt from all requirements of this section if the following guidelines are met.

A total evacuation policy is in place.
  • An emergency action plan and a fire prevention plan are established which meet the requirements of 1910.38.
  • Extinguishers are not available in the workplace.

However, if a specific standard in Part 1910 requires that a portable extinguisher be provided, then the employer is not exempt from the requirements of 1910.157.
