Hazardous Waste Disposal - Land Disposal Restrictions

As of 1992, all RCRA hazardous wastes are prohibited from land disposal without prior treatment.

EPA has identified certain wastes that must be treated prior to land disposal. For these wastes, EPA has set levels or methods of treatment that substantially diminish the toxicity of wastes or reduce the likelihood that hazardous constituents from wastes will migrate from the disposal site.

Generators must notify treatment, storage, and disposal facilities if they send them land disposal restricted wastes. If the generator determines that the concentration of its wastes is below the treatment standard, and decides to ship the waste to a land disposal facility, the generator must certify that the waste meets the designated treatment standards.

The Land Disposal Restrictions are codified in 40 CFR Part 268 and should be studied carefully.
