Waste Generators - Point of Generation 
The "point of generation" refers to the
location where wastes initially accumulate and is under the control of the operator of the
waste-generating process. Identifying the point of generation is sometimes difficult, due
to the many site specific factors that affect how and when the waste is considered to be
generated. For this reason, when a generator is having difficulty identifying the point of
generation, it is always a good idea to obtain a site specific determination from the
state or implementing agency.
There is no time limit imposed upon waste stored at the point of generation. Up to 55
gallons of hazardous waste or one quart of acutely hazardous waste may be stored at or
near the point of generation for any period of time ( 40 CFR §262.34(c) ). Although 55
gallons of waste is allowed by the regulations to be stored in the laboratory -- THIS IS
NOT A SAFE PRACTICE.
Although there is no regulatory time limit on hazardous waste, in quantities <55
gallons, stored in the laboratory, there are other requirements which do apply.
Hazardous waste containers in the laboratory must be marked "Hazardous Waste" or
with words that identify the contents of the container.
