§261.21 Characteristic of Ignitability.
In 40 CFR section 261.21, characteristic of ignitability, an oxidizer is defined in 49 CFR
section 173.151. Since the promulgation of this standard, DOT has redefined oxidizers and
moved the definition within 49 CFR. However, verbal guidance from the Agency requires
generators to use the original definition of an oxidizer found in section §173.151, until
40 CFR is updated to reflect these changes. For your convenience this definition is cited

An oxidizer is a substance such as a chlorate, permanganate, inorganic peroxide, or a
nitrate, that yields oxygen readily to stimulate the combustion of organic matter.
